La Corte Suprema descartó parte de la ley McCain-Feingold de financiacimiento de campañas electorales que prohibía a empresas y sindicatos que hagan publicidad por televisión en un período cercano a las elecciones. El abogado John Bonifaz, de Voter Action (Acción de los Votantes) afirma que la Corte Suprema está socavando el proceso electoral al conceder a las empresas derechos de la Primera Enmienda, de los que gozan los individuos.
